Terms of Service
1. Acceptance of Terms
By creating an account or using Spavo (the "Service"), you agree to this Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. What Spavo Is
Spavo is a scheduling and scorekeeping platform for recurring, in-person game night leagues, including poker, spades, dominoes, bunco, and other games we may add over time.
3. Money & Payments
Spavo does not collect, hold, escrow, process, or transmit money, and takes no fee or cut of any amount players choose to exchange. Any buy-ins are optional, host-controlled, and paid directly between players using third-party payment apps of their choosing (such as Venmo or PayPal). At the end of a game night, Spavo calculates a settlement based on scores entered by users; any resulting payment happens directly between players, outside of Spavo, and is confirmed only by mutual acknowledgment between the players involved. Spavo is not a party to, and bears no responsibility for, any payment made or received between users, or for any action taken by a third-party payment provider on a user's personal account.
4. Eligibility
You must be at least 18 years old to create a Spavo account. Spavo is not directed to, and should not be used by, anyone under 18.
5. Accounts
You're responsible for the accuracy of the information you provide and for activity on your account. Hosts are responsible for their leagues, including any house rules and buy-in settings they configure. You can update or delete your account at any time from within the app or by contacting support@spavo.app.
6. Prohibited Uses
You agree not to use the Service to:
General conduct
- Systematically retrieve data or content from the Service to create or compile a collection, compilation, database, or directory without our written permission.
- Trick, defraud, or mislead us or other users, especially in any attempt to learn sensitive account information such as passwords.
- Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict the use or copying of any content.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Service.
- Use any information obtained from the Service to harass, abuse, or harm another person.
- Make improper use of our support services or submit false reports of abuse or misconduct.
- Use the Service in a manner inconsistent with any applicable laws or regulations.
- Engage in unauthorized framing of or linking to the Service.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any part of the Service to you.
- Impersonate another user or person, or use the username of another user.
- Sell or otherwise transfer your account or profile.
Technical abuse
- Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other harmful material, including excessive use of capital letters and spamming.
- Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
- Delete the copyright or other proprietary rights notice from any content.
- Upload or transmit any material that acts as a passive or active information collection or transmission mechanism, including clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or similar devices (sometimes referred to as "spyware" or "passive collection mechanisms" or "pcms").
- Interfere with, disrupt, or create an undue burden on the Service or the networks or services connected to the Service.
- Attempt to bypass any measures designed to prevent or restrict access to the Service.
- Copy or adapt the Service's software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
- Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any software comprising or making up a part of the Service.
- Except as may result from standard search engine or browser usage, use, launch, or distribute any automated system, including any spider, robot, cheat utility, scraper, or offline reader that accesses the Service, or use any unauthorized script or software.
- Use automated scripts, bots, or other automated means to interact with the Service or create fraudulent league activity.
Commercial misuse
- Use a buying or purchasing agent to make purchases on the Service.
- Make any unauthorized use of the Service, including collecting usernames or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating accounts by automated means or under false pretenses.
- Use the Service as part of any effort to compete with us, or otherwise use the Service or its content for any revenue-generating endeavor or commercial enterprise not expressly permitted by us.
- Create multiple accounts to circumvent subscription requirements or access host features without a valid subscription.
Money, buy-ins, and gambling — specific to how Spavo works
These reinforce Section 3 and exist because Spavo's money architecture depends on them:
- Use the Service to conduct, facilitate, or promote unlicensed gambling or wagering operations.
- Use the Service to collect, hold, or transmit funds on behalf of other users outside of third-party peer-to-peer payment applications.
- Misrepresent payment status, including falsely confirming a buy-in payment has been made or received.
- Use the Service to organize leagues or events for commercial gambling establishments, casinos, or for-profit gaming operations.
- Use the Service to organize or promote illegal gambling activities under applicable federal, state, or local law.
- Attempt to circumvent, manipulate, or interfere with the buy-in tracking or settlement features to misrepresent game outcomes or financial results.
- Share, sell, or expose another user's payment handles, contact information, or financial details obtained through the Service.
- Impersonate a host, player, or Spavo representative to gain unauthorized access to leagues or payment information.
- Use the Service to facilitate buy-ins or settlements that exceed amounts permitted by applicable law for recreational social gaming in your jurisdiction.
7. Copyright & DMCA
Spavo respects intellectual property rights. If you believe content on Spavo infringes your copyright, send a notice to our designated agent at dmca@spavo.app including the information required under the Digital Millennium Copyright Act. We will respond to valid notices, provide a counter-notice process for affected users, and terminate accounts of repeat infringers under a three-strikes policy.
8. Termination
We may suspend or terminate accounts that violate this Terms of Service, including any violation of Section 6. You may stop using Spavo and delete your account at any time.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPAVO LLC AND ITS MEMBERS, OFFICERS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SPAVO IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. SPAVO IS NOT RESPONSIBLE FOR ANY PAYMENT MADE OR RECEIVED BETWEEN USERS, OR FOR ANY ACTION TAKEN BY A THIRD-PARTY PAYMENT PROVIDER (INCLUDING ACCOUNT FREEZES OR HOLDS) ON A USER'S PERSONAL PAYMENT ACCOUNT.
11. Dispute Resolution
Before filing a claim against Spavo, you agree to first contact us at support@spavo.app and attempt to resolve the dispute informally. If a dispute is not resolved within 30 days, it may be brought in accordance with Section 12 (Governing Law).
12. Governing Law
This Terms of Service is governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection laws of the jurisdiction where you reside.
13. Changes to These Terms
We may update this Terms of Service from time to time. Material changes will be communicated in-app or by email before they take effect.
